Terms of Service

1. What Haulpoint is — and is not

Haulpoint operates an online information marketplace that lets freight brokers and shippers publish load information and lets motor carriers view that information and respond with offers. Haulpoint is not a motor carrier, property broker, freight forwarder, customs broker, shipper's agent or insurer. We do not take possession of freight, arrange transportation, set rates, dispatch drivers, or act as a party to any transportation contract formed between users.

2. No liability for user transactions

All agreements for the movement of freight are formed directly between the posting party and the carrier. Haulpoint is not responsible and accepts no liability for non-payment or late payment by a broker or shipper, cargo loss, theft, damage or delay, double-brokering, detention, accessorial or claims disputes, regulatory violations by a user, or the accuracy of any information a user posts. Your sole remedies lie against the other party to your transaction.

3. Verification is a screening aid, not a guarantee

Haulpoint collects and displays operating-authority, bond and insurance information (USDOT, MC, CVOR, CTQ, NSC, surety bond and certificates of insurance) and may check it against government and third-party sources. These checks are point-in-time screening aids. Authority can be revoked and insurance can lapse at any moment. Every user remains solely responsible for independently vetting their counterparty before tendering or accepting freight.

4. User obligations

You warrant that you hold and will maintain all authority, registrations, bonds and insurance required in every jurisdiction you operate in, including U.S. federal operating authority with the required surety bond for brokers, provincial registrations such as Ontario CVOR or Quebec CTQ, and National Safety Code compliance in Canada. You will not double-broker or re-broker freight without the posting party's written consent, impersonate another company, or scrape, resell or republish load data.

5. Cross-border freight

Users moving freight between Canada and the United States are solely responsible for customs compliance, including PAPS and PARS filings, manifest accuracy, bonded carrier status and the engagement of a licensed customs broker. Haulpoint provides data fields for this information only.

6. Rates, currency and distances

Rates are displayed in the currency selected by the posting party (USD or CAD). Any currency, mileage or weight conversion shown is an indicative convenience calculation only and is not a quotation. Routing distances are estimates and are not a substitute for commercial truck routing, bridge-height, weight-restriction or hazmat clearance checks.

7. Suspension

We may suspend or remove any account that fails verification, files false information, or is reported for double-brokering or fraud, at our discretion and without notice.

8. Disclaimer and limitation

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Haulpoint's total aggregate liability arising from your use of the service is limited to the fees you paid to Haulpoint in the three months preceding the claim.

9. Contact
